TERMS AND CONDITIONS

Article 1 - APPLICABLE RULES TERMS

These terms and conditions, as may be amended from time to time, apply to all our services, made available directly on-line, by e-mail or by telephone. By accessing, browsing and using our web site, or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below. The present contract is subjected according to the establishment concerned in the status of Holiday residences. In every case the customer cannot take advantage of applicable legal requirements in leases of house, in particular as for the preservation in places.

Article 2 - RESERVATION

The reservation of a suite in COSY'S residence is valid only after acceptance of the reservation of the customer by COSY’S. The booking confirmation of the customer by COSY’S stays in the whole discretion of COSY’S. Furthermore, the reservation must, to be firm, be guaranteed by a credit card emitted by a renowned establishment and of current validity (a number of bank card, its date of validity as well as the cryptogram of safety will be asked you) or to have been the object of a preliminary credit arrangement with COSY’S or still to be followed by the payment of deposit. The above-mentioned deposits will have to correspond in the night for the stays of less than 7 nights and to 30 % of the total amount of the stay for the superior stays in seven nights. However in the case of the superior stays in 29 nights the amount of the stay held as base of calculation will be the amount equivalent to a month. The multiple reservations (that means reservations for more than 5 rooms or apartments made by the same entity) are subjected to the particular conditions of reservation of the groups.

Article 3 - TERMS OF PAYMENT

Invoices must be settled on delivery. The day of the arrival, COSY’S will request the payment of its stay. However in the case of the superior stays in 29 nights the amount of the stay held as base of calculation will be the amount equivalent to a month. In case of longer stay, the price of new period is payable beforehand. The early departure gives rise to no refund and can pull a change of price list. No discount is applied for pre-payment. The optional services are payable beforehand. In case of not payment of invoices in their date of terms, COSY’S will be entitled to a monthly interest of equivalent delay with 3 times the amount of the legal interest. In the cases where it was been advisable that the payment of the stay of a customer would be made by a third pard, the customer will remain personally responsible for the payment.

Article 4 - INVOICING

Invoices are established under the name of the physical person or of the legal entity when she(it) takes care of the price of the accommodation, what he must be justified by a letter of the legal entity, sent to the reservation or at the latest upon the arrival of the customer.

Article 5 - PRICE

The prices are indicated in EURO. The prices get inclusive of all taxes and include the provision of the suite, the studio or the apartment included loads (water, electricity, heating), except of the city tax, to be paid on the spot. The optional services are not included in the prices.

Article 6 – LENGTH OF STAY

The duration of the stay is the one planned in the confirmation of reservation or in the offer of accommodation. The total duration of a stay cannot exceed a period continuous of 6 months, carried in nine months for the students exclusively.

Article 7 - MODIFICATIONS OF RESERVATION OR OF DURATION OF the STAY

- Longer stay:

Subject to availability and in the discretion of COSY’S, the duration of the stay can be longer, with no obligation of preservation in the same apartment, nor at the same price. In case of extra time of stay which would carry the duration of the stay in more than 9 months, a new offer of accommodation will be drafted and the change of apartment would be compulsory. In case of accepted extra time of stay and application of a new price, this one will be applicable to the date of the beginning of the continuation. For the stays having been the object of an offer of accommodation, a new offer of accommodation will be drafted.

- Early departure:

In case of the early departure, the applicable price will be the one corresponding to the duration so shortened. Any rate amendments connected to an early departure will apply retroactively at the account of the customer as from the date of its arrival.

Article 8 - CANCELLATIONS / NO SHOW

- CANCELLATIONS:

By making a reservation with a hotel, you accept and agree to the relevant cancellation and no-show policy of that hotel.
Please note that certain rates or special offers are not eligible for cancellation or change.
Please note that you may be charged for your cancellation in accordance with the hotel’s cancellation and no-show policy.
Any received cancellation before 12 heures* the day before the day of arrival will not be subjected to expenses of cancellation. Any cancellation received after this deadline will be subjected to equal expenses of cancellation:

  • one night (more tax) for the stays of less than seven nights,
  • two nights (more tax) for the stays from seven to twenty nine nights,
  • three nights (the more tax) for the stays of thirty nights or the more.

* Local time of the residence concerned by the reservation.

Article 9 – CHECK IN AND CHECK OUT

The delivery of keys is made from 3:00 pm the day of the arrival. These keys will be returned before 12:00 am the day of the departure.

Article 10 - OBLIGATIONS OF THE CUSTOMER AND INVENTORY

The Customer will make a peaceful custom of the room or the provided him with apartment and will behave so as to respect the tranquillity of the other occupants of the residence.
The Customer makes a commitment to conform to the capacities of the present as well as to the internal rules terms of the establishment which he recognizes and accepts expressly.
The Customer makes a commitment not to take up residence at the address of the establishment, neither on the fiscal plan, nor professionally, nor to give, to sublet, whatever title it is, the room or the apartment to a third party.

The Customer will watch his personal effects and will take all the precautions of custom towards his personal properties.
The Customer makes a commitment to keep(preserve) the household effects provided him with in the room or the apartment in good condition general and will have to declare to the reception any defect or dysfunction.
An inventory represents in every suite, studio or apartment. The customer will have to verify the exactness and the quality from his arrival and indicate to the reception any abnormality, missing or degraded objects, if necessary from his arrival. During the departure, the inventory and the state of cleanliness of the apartment will be the object of a control by COSY’S and every lack in the inventory or damage caused in the suite, in the studio or in the apartment will be charged to the customer. COSY’S reserves the right to penetrate into places rented for the maintenance or the safety. At the end of the stay the customer will have to return the room, the studio or the clean and in order apartment; the customer is anxious to clean the dishes used during his(her,its) stay; should the opposite occur, a fixed supplement will be charged to him(her).

Article 11 - RESPONSIBILITY

COSY's responsibility cannot be engaged in case of thefts or of damages of personal effects, in suites and apartments, including in the individual safety box, the common premises, the parking lots and quite other dependences or appendices of the establishment. For COSY's establishments, provisions of the articles 1952 and following ones of the civil code, relative to the hotelkeepers, are not applicable.

Article 12 - SLEEPINGS

Our suites are planned for a maximum number of persons.
In case of non compliance with the capacity of the suite, Cosy's residence reserves the right to refuse the access to this one. Without preliminary agreement of the reception, a 50,00-€ supplement a day and a person will be added.
Beds of supplements can be proposed on inquiry in certain suites, within the limits of the possibilities; this product is the object of one fixed supplement. This type of sleeping is convenient for a person of no more than 12 years old.

Article 13 - MODIFICATION OF OUR SERVICES

In case of events of force majeure, COSY’S would be in the obligation to modify partially or totally the services (total or partial closure of a site, a common equipment of type, room of breakfast). COSY’S can be on no account held for responsible of these possible changes and no compensation can be asked.

Article 14 - AFTER-SALES SERVICE

The on-site teams are at your disposal to answer the complaints, resolve the possible noticed dysfunctions and allow the customer to take advantage completely of the stay in the establishment chosen by this last one. Any complaint, after the stay of the customer, can be the object of a sent mail, by registered letter with recorded delivery, in: COSY’S - Customer relations service - 69/71 Boulevard Vauban - 59000 LILLE, within 2 months after the end of the stay. The customer will have to stipulate the name of the person having reserved the stay, the places and dates the stay, the type of apartment or room reserved, as well as any documentary evidences so as to facilitate the treatment of the file.

Article 15 - TERMINATION - PENALTIES - NOT RENEWAL

For lack of payment in the agreed term or for lack of executing the only one of the obligations put chargeable to the Customer, the present contract will be cancelled by rights if good seem to the Manager of the establishment and after a single command to pay and\or a reminder to make or not to make remained fruitless. The eviction will be pronounced by simple prescription of emergency proceeding.
For lack of payment in the agreed term and\or in case of grave breach in its obligations, in particular in case of preservation in places beyond contractual period, the person in charge of the establishment can forbid the access to the room by every possible means and will hold the personal effects of the Customer at his/her disposal in a premises " planned for that purpose ", what the Customer recognizes and accepts.
